The BNP Paribas Fortis Community hosted on this Site is yours: it’s open to all, and we invite you to post your comments, suggestions, photos and videos in accordance with the Site’s Rules and Terms of Use.

The BNP Paribas Fortis Community is subject to moderation: any breach of the Site’s Rules or Terms of Use will result in the content concerned being deleted without notice and, if necessary, the user being excluded.

If you access and this Site, this means that you unconditionally agree to these Terms of Use and Rules.

1. The BNP Paribas Fortis Community

The BNP Paribas Fortis Community Site (the "Site") is a social media platform of BNP Paribas Fortis SA, a Belgian credit institution subject to the control of the authorities mentioned in point 12 and whose registered address is Montagne du Parc 3, B-1000 Brussels, VAT BE 0403.199.702 - RPM Brussels ("BNP Paribas Fortis").

2. Site features

The Site allows you to consult the various forums hosted on it, which contain posts and messages posted by BNP Paribas Fortis Community moderators and users on the topics identified in the header of each forum.

By creating a profile, anyone can post messages and participate in the Community in accordance with the Rules.

Users can also exchange private messages with other users and moderators via the messaging service provided. Moderators will contact users through this channel to assist them in using the Community or when they deem their comments inappropriate.

Users will be notified by email of any reaction to their publication or one of their "favourite" topics, as well as when they receive a new message. If, however, the user no longer wishes to receive alerts, they can modify their settings accordingly on the Site.

3. Content published by BNP Paribas Fortis

The information and materials published by BNP Paribas Fortis on this Site are provided solely for information purposes and do not constitute an offer of financial, banking, insurance or other products and services.

They do not aim to provide advice, including but not limited to financial, tax, accounting or legal advice.

BNP Paribas Fortis will make every effort to control and regularly update the information and materials it has published on the Site and to verify the reliability and honesty of their sources.

Consequently, the information and materials published by BNP Paribas Fortis on this Site are subject to change. BNP Paribas Fortis cannot guarantee the accuracy, adequacy, completeness or timeliness of the information and materials contained on the Site or to which it refers; it cannot guarantee that these information or materials are suitable for a specific purpose or that their sources are reliable and honest.

BNP Paribas Fortis, the companies of the group to which it belongs, their directors, employees and/or representatives cannot be held liable, for any reason, contractually or otherwise, for any direct or indirect harm you may suffer as a result of accessing, visiting and/or using this Site, except in the event of gross negligence or intentional wrongdoing attributable to them.

The content of the Site may be modified.

4. Content published by Site users

Users who have created a profile can react to comments or create new topics.

Users will be assigned both a ranking, based on the number of topics they post and the number of responses they give in the Community, and a badge, based on the quality of the responses they give, as judged by Community members; the user's ranking and badge cannot be regarded as an objective guarantee of the quality of their publications.

In order to ensure consistency and readability, Community moderators may move certain comments to include them in a more suitable category, close an inappropriate discussion or highlight a particularly relevant response.

Any breach of the Site’s Rules or Terms of Use will result in the deletion without notice of the relevant content, and if necessary, the exclusion of the user and the deletion of their profile, without any compensation to the user concerned.

In the event that a user is excluded, they will be prohibited from re-registering with the Community.

If the user leaves the Community, voluntarily or not, their messages and posts will remain visible on the Site. However, they have the option to request that moderators anonymise their publications.
BNP Paribas Fortis may hold any user liable for the posts, comments or content they publish.

BNP Paribas Fortis does not have sufficient resources to check all comments published on the Community; despite subsequent checks carried out by moderators, BNP Paribas Fortis cannot be held responsible for the content published by users, regardless of their ranking.

To help ensure that the Community is fit for purpose, any user may report to BNP Paribas Fortis, via community@bnpparibasfortis.be, any message they consider non-compliant with the Rules.

5. Other standard terms and conditions and links to third-party sites

Certain parts or pages of the Site may mention separate and/or additional terms and conditions, which constitute additions to these Terms of Use.

If there is any contradiction between these Terms of Use and the separate and/or additional terms of conditions, the latter will prevail with respect to the parts or pages of the Site to which they relate.

This Site may also contain links to other sites published by third parties. Links to this Site must also be regarded as part of such third-party Sites. BNP Paribas Fortis has not checked these third-party Sites and cannot be held liable for information or materials on any site accessible via links on this Site. The creation of a link to a third-party site or the authorisation of a third-party site to create a link to this Site does not mean that BNP Paribas Fortis approves or recommends the products or services offered on that third-party site. 6. Intellectual property rights

6.1. Content published by BNP Paribas Fortis

The information and materials published by BNP Paribas Fortis on the Site are protected by intellectual property rights belonging to or claimed by BNP Paribas Fortis, the companies of the group to which it belongs or third parties. The information and materials may be reproduced and printed by you, but only for your personal use and for non-commercial purposes, provided that you do not remove the references to these intellectual property rights.

Users undertake not to disseminate the information and materials, reproduce them or sell them, in any form and in any way, without the prior written authorisation of BNP Paribas Fortis. They also undertake to comply with the general terms and conditions of third parties for using the information and materials belonging to them and reproduced on this Site.

6.2. Content published by users

Users of the Site grant BNP Paribas Fortis a non-exclusive, worldwide licence, free of charge, for all content and materials they publish on the Site for a period of 10 years.

They warrant to BNP Paribas Fortis that they are the holders of all intellectual property rights or other necessary rights in relation to the content they publish for the purposes of the licence they grant to BNP Paribas Fortis, or that they have the necessary authorisations from the rights holders, which they will provide to BNP Paribas Fortis upon request.

No compensation will be paid to users for the messages they publish within the Community.

If necessary, users assign their image rights to BNP Paribas Fortis in respect of the aforementioned materials and expressly authorise BNP Paribas Fortis to determine, reproduce, communicate to the public and in general exploit and use such materials:

• in any form and on all media, including paper, textiles, wood, plastic, computer, electronic, magnetic, digital, laser, optical and any medium readable by humans directly or through a machine, for all modes of dissemination (existing or future), including the internet and social media
• for all products or services related to BNP Paribas Fortis's activity worldwide, in whole or in part, for all its areas of operation, including promotion and illustration.

Users authorise BNP Paribas Fortis to make changes to these materials (cropping, retouching, modifying etc.) and to associate them with other content, including images, texts, graphics, films, sounds and audiovisual media. Users expressly waive their moral right to object to such changes.

7. Protection of personal data and use of cookies

Reference is made to the Privacy Policy and Cookies Policy available on the Site.

Any person using the Community agrees to the recording and processing of the messages they post, including their content and traffic data, in order to ensure the monitoring of the Bank's activities, the quality of its services, and the improvement of its existing or future products and services. Data relating to electronic communications and their content may be kept until the end of the period during which the underlying transaction may be disputed in court.

Private messages exchanged between users are strictly personal and, as such, their content cannot be used by the Bank.

8. Applicable law and competent courts

Access and visits to the Site, the use of the Site and these Terms of Use are subject to Belgian law and will be interpreted in accordance with Belgian legislation. Unless the law expressly designates the competent court, any claim may be brought before:

• the court with jurisdiction in the domicile of the defendant or one of the defendants
• the court with jurisdiction in the locality where the commitments or one of the commitments that are the subject of the dispute were made, or where they were, are, or must be fulfilled
• the court with jurisdiction in the locality where the judicial officer spoke to the defendant, if the defendant or any of the defendants has their domicile in Belgium or abroad.

9. Severability and modifications

Any provision of these Terms of Use that is deemed inapplicable will be replaced by an applicable provision that is as close as possible to the original intention, without affecting the other provisions, which will remain unchanged.

This agreement will be part of each of the other agreements you have formed or will form with BNP Paribas Fortis, any of the companies of the group to which it belongs, or any company for which BNP Paribas Fortis acts as an intermediary.

BNP Paribas Fortis reserves the right to modify these Terms of Use at any time, with immediate effect and without prior notice.

10. Liability of third parties

If the Site is used in any illegal or prohibited manner, such as by causing damage to the software programs used or the data made available, whether through viruses, destruction and/or manipulation of data, will result in civil and/or criminal liability.

If BNP Paribas Fortis does not invoke or pursue, even temporarily, the enforcement of any of these rights or other rights arising from these Terms of Use and/or related to the use of the Site, this cannot be interpreted as BNP Paribas Fortis having waived or renounced any right or action.

11. Supervisory authorities

BNP Paribas Fortis SA is subject, as a Belgian credit institution, to the prudential supervision of the National Bank of Belgium and the European Central Bank, as well as to the supervision of the Financial Services and Markets Authority (FSMA) in matters of investor and consumer protection. BNP Paribas Fortis SA is registered and acts, under FSMA number 25879A, as an insurance agent for AG Insurance SA, Cardiff Assurances Risques Divers SA and Europ Assistance (Belgium) SA.
